Notice of MBR Hearing

On September 2, 2021, Governor Hochul signed into law new legislation (L.2021 c. 417 “Act”) which extends and modifies provisions of the law enacted during the Covid-19 state disaster emergency. Part E of the Act, allows state and local government entities to meet remotely by conference call or similar service, so long as the public has the ability to view or listen to such proceeding and provided such meetings are later transcribed until January 15, 2022.

As such, all meetings will be held virtually on the YouTube Channel below once the livestream begins at the designated time of the meeting.  All live meetings will be recorded and will remain on the YouTube Channel for viewing.

On Thursday, November 18, 2021 the Office of Rent Administration will conduct the Maximum Base Rent (MBR) public hearing for rent controlled housing accommodations located in the City of New York for the 2022-2023 biennial MBR cycle.

Note: The 2019 Housing Stability and Tenant Protection Act (HSTPA) impacts the formula for calculating Maximum Collectible Rent (MCR) increases. The 5-year averaging of 1-year rent guidelines results in significantly lower annual increases in the MCR than the prior formula, which allowed up to a 7.5% annual increase in the MCR over 2 years until the MBR is reached.  This averaging formula results in only a 1.00% increase in the MCR for 2022.

The hearing schedule will be as follows:

  • Morning Session – 10:00am to 12:30pm
  • Break for Lunch –  12:30pm to 2:00pm
